Terms of Service

1. Acceptance of Terms

By accessing or using Vacato ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms constitute a legally binding agreement between you and Vacato.

2. Description of Service

Vacato is a domain availability monitoring service that:

• Tracks domain name availability status
• Sends notifications when tracked domains become available
• Provides WHOIS and registration information
• Offers tools to help you discover domain registration options

Important: Vacato is an informational and monitoring service only. We do not register, sell, transfer, or manage domain names. Domain registration must be completed through third-party domain registrars.

4. User Accounts

To use Vacato, you must create an account. You are responsible for:

• Maintaining the confidentiality and security of your account credentials
• All activities that occur under your account
• Providing accurate, current, and complete information
• Notifying us immediately of any unauthorized access or security breach

You must be at least 18 years old or the age of majority in your jurisdiction to use this Service.

5. Subscription Plans & Pricing

Vacato offers the following subscription tiers:

• Free: Track up to 5 domains with daily availability checks and up to 2 notification contacts
• Pro ($7/month): Track up to 100 domains with 1-minute checks, 10 notification contacts, and access to Slack/Discord/Webhook notifications
• Business ($19/month): Track up to 500 domains with 1-minute checks, unlimited notification contacts, organization/team features, and API access
• Enterprise (Custom pricing): Unlimited domains with 1-minute monitoring, dedicated support, and custom SLAs

Beta pricing notice: All pricing, features, and plan limits displayed during the beta period are subject to change at any time. We will notify existing subscribers of material changes at least 14 days in advance.

6. Billing & Payments

Paid subscriptions are billed in advance on a monthly basis. Payment processing is handled by Polar.sh, a third-party payment processor. By subscribing, you also agree to Polar.sh's terms of service.

You may cancel your subscription at any time through your account settings. Upon cancellation, your access to paid features will continue until the end of your current billing period, after which your account will revert to the Free plan.

7. Refund Policy

We offer a 14-day money-back guarantee for new paid subscriptions. If you are not satisfied with the Service, contact us within 14 days of your initial subscription purchase for a full refund. This guarantee applies only to first-time subscribers and does not apply to renewals, upgrades, or subsequent purchases.

8. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Attempt to circumvent usage limits, security measures, or access controls
• Use automated tools, bots, or scripts to access the Service beyond normal usage patterns
• Interfere with, disrupt, or overload the Service or its infrastructure
• Resell, redistribute, or sublicense the Service without written authorization
• Use the Service to harass, threaten, or harm others
• Attempt to gain unauthorized access to other users' accounts or data
• Use the Service for domain squatting, cybersquatting, or trademark infringement

9. Affiliate Disclosure

Vacato participates in affiliate programs with domain registrars including, but not limited to, Namecheap, GoDaddy, Squarespace, and ChemiCloud. When you click on links to these registrars and make a purchase, we may receive a commission at no additional cost to you. These affiliate relationships do not influence our domain monitoring services or the accuracy of availability information.

10. Service Availability & Accuracy

While we strive for high availability and accuracy, we do not guarantee that:

• The Service will be uninterrupted, timely, secure, or error-free
• Domain availability information is 100% accurate or up-to-date
• Notifications will be delivered instantly or without delay
• You will be able to register a domain that appears available
• Third-party integrations (Slack, Discord, Telegram, Webhooks, Email) will function continuously or without error
• Data from RDAP, WHOIS, or DNS lookups will be complete, accurate, or current

Domain availability checks depend on third-party WHOIS servers and DNS infrastructure that may be unavailable, rate-limited, or provide outdated information. Domain status can change at any time, and multiple parties may be monitoring the same domain. You should independently verify domain availability before making any purchasing decisions.

11. Third-Party Services & Integrations

The Service relies on and integrates with third-party services including, but not limited to:

• Supabase for data storage and authentication
• Polar.sh for payment processing
• Resend for email delivery
• RDAP/WHOIS servers operated by IANA, Verisign, and other registries
• Telegram, Slack, Discord for user-configured notifications

Vacato is not responsible for the availability, accuracy, security, or performance of any third-party service. If a third-party service experiences downtime, changes its API, imposes rate limits, or otherwise becomes unavailable, the affected functionality within Vacato may be degraded or unavailable. You agree that Vacato bears no liability for failures caused by third-party services.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WITHOUT LIMITING THE FOREGOING, VACATO EXPRESSLY DISCLAIMS ANY WARRANTY THAT:

• THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS OR EXPECTATIONS
• THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
• THE RESULTS OBTAINED FROM USING THE SERVICE WILL BE ACCURATE, RELIABLE, OR COMPLETE
• ANY ERRORS, BUGS, OR DEFECTS IN THE SERVICE WILL BE CORRECTED
• NOTIFICATIONS WILL BE DELIVERED SUCCESSFULLY THROUGH ANY CHANNEL
• DOMAIN AVAILABILITY DATA WILL BE ACCURATE OR CURRENT
• THIRD-PARTY INTEGRATIONS WILL FUNCTION AS EXPECTED
• THE SERVICE WILL BE COMPATIBLE WITH ANY PARTICULAR HARDWARE, SOFTWARE, OR NETWORK CONFIGURATION

VACATO IS NOT A DOMAIN REGISTRAR AND MAKES NO GUARANTEES REGARDING YOUR ABILITY TO REGISTER ANY DOMAIN NAME. WE ARE NOT RESPONSIBLE FOR ACTIONS TAKEN BY THIRD-PARTY REGISTRARS OR OTHER PARTIES. ANY RELIANCE ON THE SERVICE FOR DOMAIN ACQUISITION DECISIONS IS AT YOUR OWN RISK.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VACATO, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR:

• LOSS OF PROFITS, GOODWILL, DATA, OR BUSINESS OPPORTUNITIES
• MISSED DOMAIN REGISTRATION OPPORTUNITIES
• FAILED OR DELAYED NOTIFICATIONS
• INACCURATE DOMAIN AVAILABILITY DATA
• INTEGRATION FAILURES OR THIRD-PARTY SERVICE OUTAGES
• DATA LOSS OR CORRUPTION
• SERVICE INTERRUPTIONS OR DOWNTIME
• ANY OTHER INTANGIBLE LOSSES

REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER THEORY, AND EVEN IF VACATO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU ACTUALLY PAID TO US IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY US DOLLARS ($50).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Vacato and its officers, directors, employees, agents, affiliates, suppliers, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of or reliance on the Service; (b) your violation of these Terms; (c) your violation of any rights of another party; (d) your conduct in connection with the Service; (e) any domain registration decisions you make based on information provided by the Service; or (f) any content or data you submit to or through the Service.

15. Dispute Resolution & Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

You and Vacato agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved through binding arbitration, rather than in court, except that either party may seek equitable relief in court for infringement or misuse of intellectual property rights.

Class Action Waiver: You and Vacato agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than arbitration, both parties waive the right to a jury trial.

Before initiating arbitration, you agree to first contact us at support@vacato.io to attempt to resolve the dispute informally within 30 days.

16. Intellectual Property

The Service, including its design, features, content, trademarks, logos, and software, is owned by Vacato and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written permission.

You retain ownership of any data you submit to the Service. By using the Service, you grant us a limited license to use, process, and store your data solely to provide and improve the Service.

17. Termination

We may suspend or terminate your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. You may delete your account at any time through the Settings page.

Upon termination: (a) your right to use the Service will immediately cease; (b) we may delete your account data in accordance with our Privacy Policy; (c) any provisions of these Terms that by their nature should survive termination shall survive (including warranty disclaimers, limitation of liability, indemnification, and dispute resolution).

18. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service at least 14 days before they take effect. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

19. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

20. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

21. Entire Agreement

These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and Vacato regarding the Service and supersede all prior agreements, understandings, and communications.
